OVERVIEW

This website is operated by Byrdband. Throughout these Terms of Service, “Byrdband,” “we,” “us,” and “our” refer to Byrdband. “You” and “your” refer to any visitor, customer, or user of this website.

By accessing this website, purchasing a product, or using our services, you agree to these Terms of Service and all policies referenced within them. If you do not agree, you should not use this website or purchase our products.

  1. ELIGIBILITY

You must be at least 18 years old or have the permission and supervision of a parent or legal guardian to use this website or purchase Byrdband products.

You agree to provide current, complete, and accurate account, billing, shipping, and payment information.

  1. PRODUCTS AND AVAILABILITY

We make reasonable efforts to display product descriptions, photographs, colors, specifications, prices, and availability accurately. However, the appearance of colors and details may vary depending on your device or display.

Products, prices, promotions, and availability may be changed or discontinued without notice. We may limit product quantities or refuse an order when reasonably necessary.

  1. ORDERS

Submitting an order does not guarantee acceptance. We reserve the right to refuse, limit, or cancel an order for reasons including:

  • Product unavailability

  • Incorrect pricing or product information

  • Suspected fraud or unauthorized activity

  • Payment problems

  • Resale or excessive-quantity concerns

  • Errors in the customer’s billing or shipping information

If payment has already been collected for a canceled order, the applicable amount will be refunded to the original payment method.

  1. PRICING, PAYMENT, AND TAXES

Prices are displayed in the currency shown at checkout. Applicable taxes, shipping costs, customs charges, or other fees may be added at checkout.

You authorize Byrdband and its payment providers to charge the payment method submitted with your order. Byrdband does not guarantee that every payment method will remain available.

  1. SHIPPING AND DELIVERY

Orders are subject to our published Shipping Policy. Processing and delivery dates are estimates and are not guaranteed.

Byrdband is not responsible for carrier delays, weather disruptions, customs delays, or other events outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. Additional shipping charges may apply if an order is returned because of an incorrect or incomplete address.

  1. RETURNS AND REFUNDS

Returns are accepted within 14 days of delivery.

To qualify, the product must be in good, clean condition, unused or free from visible wear, undamaged, complete, returned with its original packaging when available, and accompanied by proof of purchase.

Before returning a product, contact byrdband@byrdband.com with your order number and reason for the return. Returns sent without prior approval may not be accepted.

Customers are responsible for return shipping unless the product arrived damaged, defective, or incorrect. Original shipping charges are nonrefundable.

Returns are inspected before approval. Items returned after 14 days or in used, damaged, dirty, or incomplete condition will not qualify for a refund.

  1. PRODUCT USE AND SAFETY

Byrdband products are exercise and athletic-training accessories. They are not medical devices and are not intended to diagnose, treat, cure, or prevent a medical condition.

You agree to:

  • Read and follow all product instructions

  • Inspect the product before each use

  • Use the product only for its intended purpose

  • Select exercises and resistance appropriate for your ability

  • Stop using the product if it becomes worn, damaged, or defective

  • Stop exercising if you experience pain, dizziness, numbness, shortness of breath, or unusual discomfort

Consult a qualified medical professional before beginning a new exercise program, especially if you have an injury, medical condition, mobility limitation, or other health concern.

Anyone under 18 should use the product only with appropriate adult, coach, trainer, or professional supervision.

  1. ASSUMPTION OF RISK

Physical activity involves inherent risks, including overexertion, falls, muscle strain, loss of balance, and other injuries.

By using a Byrdband product, you acknowledge these risks and accept responsibility for using the product properly and selecting activities suitable for your health, experience, and fitness level.

  1. PERFORMANCE DISCLAIMER

Individual results vary. Byrdband does not guarantee improvements in running speed, arm movement, form, strength, endurance, weight loss, athletic performance, or competition results.

Testimonials, demonstrations, photographs, videos, and customer experiences do not guarantee that every user will achieve the same outcome.

  1. INTELLECTUAL PROPERTY

The Byrdband name, logos, product designs, website content, photographs, videos, graphics, instructions, marketing materials, and other content are owned by or licensed to Byrdband and may be protected by trademark, copyright, patent, trade-dress, and other intellectual-property laws.

You may not copy, reproduce, modify, manufacture, distribute, publish, sell, reverse engineer, or commercially use Byrdband intellectual property without prior written permission.

  1. CUSTOMER REVIEWS AND SUBMISSIONS

If you submit a review, photograph, video, comment, testimonial, suggestion, or other content, you confirm that:

  • You own or have permission to submit the content

  • The content is truthful and reflects your genuine experience

  • The content does not violate another person’s rights

  • The content is not unlawful, threatening, misleading, defamatory, or obscene

You grant Byrdband a nonexclusive, worldwide, royalty-free license to use, reproduce, edit, publish, and display submitted content for business and promotional purposes, subject to applicable law.

We may remove submitted content that violates these Terms.

  1. PROHIBITED USES

You may not use this website:

  • For unlawful, fraudulent, or deceptive purposes

  • To violate intellectual-property or privacy rights

  • To transmit malware or harmful computer code

Occasionally, website information may contain typographical errors, inaccuracies, or omissions relating to descriptions, pricing, promotions, shipping, availability, or other matters.

We may correct errors, update information, or cancel affected orders at any time. If an order is canceled after payment, the applicable amount will be refunded.

Except for warranties that cannot legally be excluded, this website, its content, and Byrdband products are provided on an “as available” basis.

We do not guarantee that the website will always be uninterrupted, secure, or error-free. We do not make warranties beyond those expressly stated in writing or required by applicable law.

To the fullest extent permitted by law, Byrdband will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of this website, purchase or use of a product, service interruptions, or third-party conduct.

Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited, including rights relating to defective products or personal injury where applicable.

To the extent permitted by law, you agree to indemnify and hold Byrdband harmless from third-party claims, losses, or expenses arising from your unlawful misuse of the website or products, your violation of these Terms, or your infringement of another person’s rights.

  1. SEVERABILITY AND WAIVER

If any provision of these Terms is found unenforceable, the remaining provisions will remain effective.

Our failure to enforce a provision does not waive our right to enforce it later.

  1. GOVERNING LAW

These Terms are governed by the laws of the State of Alabama and applicable federal law, without limiting any mandatory consumer protections provided by the laws where you reside.

We may update these Terms periodically by posting a revised version on this website. Changes become effective when posted unless otherwise stated.

Your continued use of the website after changes are posted constitutes acceptance of the revised Terms.
